What is spread-of-hours pay, and what is the ten-hour wording difference?
Spread-of-hours pay is an extra hour at the minimum wage for qualifying long restaurant workdays. The span includes breaks and split shifts, not just time actively working.
The mailed notice says ten hours or more, while the administrator’s FAQ and the Attorney General’s eligibility information sheet say more than ten hours. If your workday lasted exactly ten hours, ask Atticus to check your eligibility. We have not treated those wordings as identical.

How much will I receive?
The Attorney General reviews payroll and time records to determine each worker’s portion. The fund is $440,000 overall, not $440,000 per person. The notice gives no individual payment estimate.

How do I file, and what if I did not get a notice?
File online or send the completed paper form to Atticus by October 31, 2026. The online login requires your Claimant ID and last name. Use the administrator’s official claim page; no one needs to charge you to file.
If you think you qualify but have no notice, contact Atticus. Its FAQ allows records to be submitted for review if it cannot confirm your eligibility. The Attorney General decides whether you qualify.

When and how are payments made?
The administrator’s FAQ says valid claims are paid as they arrive, within 15–30 days. Its listed choices are ACH bank transfer, Zelle, PayPal, Venmo, Virtual Mastercard or paper check. Choose a method on your form and keep your address current. This is not a guarantee of a particular delivery date.

Can child support or other judgments reduce my payment?
Yes. The notice says certain New York child-support debts or judgments may be deducted, and the responsible state agency will notify you.
The response periods differ: page 2 of the mailed notice says 45 days, while the administrator’s current website says 14 days. If you receive a deduction notice, contact that agency and Atticus promptly to confirm the applicable deadline; do not assume you have 45 days.

Will I receive a tax form?
Yes. The notice says you will receive an IRS Form W-2 with your wage payment. Keep your mailing address updated with Atticus so payments and tax documents reach you.
Can someone claim for a worker who died or cannot act for themselves?
Contact Atticus by October 31, 2026 about a representative claim. An extension may be available for required paperwork, but it is not automatic. The administrator’s FAQ describes different documents for estates, guardians and people holding a power of attorney; requirements also depend on where the worker lived.

Are there protections for current workers too?
Yes. The agreement requires clearer wage policies, pay statements that identify this extra pay, employee training, complaint handling and protections against retaliation. These workplace changes are separate from the individual wage payments.

Do I need a lawyer or pay a filing fee?
