Kimball v. Country Bank for Savings: Fee Refund Settlement

The proposed $495,000 settlement resolves claims about overdraft and non-sufficient-funds fees charged by Country Bank for Savings. The settlement class covers people assessed the challenged fees from March 12, 2019 through December 31, 2025, who receive a proportional refund of those fees - capped at what they actually paid - plus forgiveness of qualifying unpaid fees, automatically once the court approves the settlement. The court has not yet given final approval.

Country Bank Challenged Fees Settlement

No claim required

Who qualifies?

You qualify if your Country Bank consumer deposit account was charged an unrefunded repeat NSF or overdraft fee on a resubmitted payment, or an overdraft fee on a transaction that did not overdraw the account, between March 12, 2019 and December 31, 2025.

How much could I receive?

You receive a proportional share based on eligible fees, capped at the qualifying fees you paid. Some eligible uncollected fees may also be forgiven; there is no guaranteed flat cash amount.

Do I need supporting documents?

No claim form or supporting documents are required. The bank and administrator use account records to calculate payments.

Do I need a notice ID or PIN?

No notice ID or PIN is required to receive the automatic benefit.

What is the deadline?

There is no claim filing deadline. The June 22, 2026 objection deadline was separate and has passed; no objection is needed to receive the automatic payment.

What do I need to do?

No claim is needed. Eligible open accounts receive a credit, while former account holders receive a check; keep your mailing address current. The saved sources do not confirm approval or distribution after the scheduled hearing.

Which fees does this settlement cover?

The settlement covers these two types of Challenged Fees if Country Bank charged them during the Class Period, March 12, 2019 through December 31, 2025.

  • Retry Fees: overdraft fees and NSF fees on an item coded or classified as having previously incurred an NSF fee.
  • Account Balance Fees: overdraft fees on a transaction that did not overdraw the account.

How do I know whether I am included?

If Country Bank’s records show that you were assessed a Challenged Fee, you are a Class Member. The notice says that receiving an email or postcard notice means you are included. If you are unsure whether you were properly included, the notice says you can call the number printed at the bottom of the notice.

Do I need to file a claim or provide documents for a payment or account credit?

You do not need to submit a claim form or take other action to receive a settlement payment or account credit. If you move, call the number at the bottom of the notice to give your new address so a payment can reach you.

How much could my payment or account credit be?

Payments or account credits will come from the Net Settlement Fund, after Court-approved fees, expenses, notice and administration costs, and service awards are deducted. Each Class Member’s share is based on the amount of applicable Challenged Fees that person paid compared with the applicable fees paid by all Class Members.

Your payment or credit cannot be more than the applicable fees you paid, and the notice says it will likely be less. The independent settlement administrator will calculate the amount.

What is the $495,000 settlement fund used for?

Country Bank agreed to pay $495,000 into the Settlement Fund. That is the total fund, not the amount each Class Member will receive. Settlement administration costs, notice costs, approved attorneys’ fees and expenses, and any approved service awards are paid from that fund before the remaining money is distributed.

What does the notice say about debt forgiveness?

The notice says Class Members who do nothing may receive debt forgiveness as well as, or instead of, a check or account credit. But it does not explain who qualifies for debt forgiveness, how much would be forgiven, or how it relates to the payment-or-credit formula.

When might payments or account credits be sent?

The Court is scheduled to consider final approval on August 11, 2026, at 2:00 p.m. You do not need to attend. Even if the Court approves the settlement, payment distribution must wait until any appeal period or appeals are resolved. The notice says this may take several months and perhaps more than a year.

What happens if I do nothing?

If you do nothing, you remain in the settlement. If it becomes final, you will receive the settlement benefits that apply to you, but you give up the right to bring or continue a lawsuit against Country Bank about claims that were or could have been brought in this case.

How can I object to the settlement?

You may object if you are a Class Member. Your written objection must give your name, address, telephone number, signature, and the reasons for your objection. Include any evidence or legal argument you want the Court to consider.

Mail it to the address in the notice and make sure it is postmarked by June 22, 2026. Objecting does not prevent you from receiving applicable settlement benefits if the settlement is approved.

Can I attend or speak at the Court hearing?

You may attend the Final Approval Hearing at your own expense, but you are not required to do so. To ask to speak, send a Notice of Intention to Appear with your name, address, telephone number, signature, and any evidence you intend to use. It must be postmarked by June 22, 2026 and sent to the objection address in the notice.
