Who is included, and who is excluded?
The settlement covers living people who used either the MyChart patient portal on Cone Health’s website or a submission form on that website during the stated period. Using both is not required; either type of website activity can meet the basic definition.
Some people are excluded even if they had that activity. These include Cone Health-related employees, officers, and agents; certain related entities and their personnel; Class Counsel; court personnel and specified family members; and people who properly opt out.
Why is there no set dollar amount for my payment?
There is no fixed payment amount. The $1,765,000 fund will first be used for approved attorneys’ fees and expenses, a service award for the class representative, and settlement administration costs. The remaining money will be divided equally among people who submit valid, timely claims.
Your payment therefore depends on how many valid claims are approved and on the amounts taken from the fund for those approved costs. The notice does not provide an estimated dollar payment per person.
What must I do to make a claim, and does the notice require proof?
To seek a payment, submit a valid claim form by October 5, 2026. You may submit the form online or mail a paper form. A mailed paper form must be postmarked by that date.
The form requires you to affirm that you had qualifying MyChart or website-form activity during the class period and sign the form. The notice does not say that you must provide documents proving a financial loss or supporting the affirmation.

What happens if I opt out, and how do I do it?
Opting out means leaving the settlement. If you opt out, you will not receive a settlement payment, but you keep any right you may have to bring or remain in your own related case against the defendants.
Your written request must state the case name, your full name and current address, include your personal signature, and say “Request for Exclusion” or clearly say that you do not want to participate. Mail it to the Settlement Administrator so it is postmarked no later than October 5, 2026. You can submit an exclusion request only for yourself.
Can I object instead of opting out?
An objection tells the court why you oppose some or all of the settlement while remaining in it. You may still file a claim if you object. Opting out is different: a person who opts out cannot object because the settlement no longer applies to them.
The notice has detailed objection requirements. Among other things, it calls for your contact information, signature, proof of class membership, the reasons for the objection, and supporting documents you want the court to consider. The written objection must be filed with the court, with copies served on both sides’ lawyers, by October 5, 2026.
What rights do I give up if I stay in the settlement?
If you stay in the settlement and do not opt out, you give up the ability to sue, continue suing, or join another lawsuit against the defendants over the legal claims resolved by this settlement. This applies even if you do not submit a claim.
The notice does not list every released claim. It says the full release is in the Settlement Agreement.
Do I need to attend the final approval hearing?
The court is scheduled to hold the final approval hearing on November 5, 2026, at 2:00 PM Eastern Time in Greensboro, North Carolina. At that hearing, the court will consider whether to approve the settlement, fees and costs for Class Counsel, the service award, and objections.
You do not have to attend. A timely written objection will be considered even if you do not go. The hearing date or time may change.
When could payments be sent?
There is no guaranteed payment date. Payments can be distributed only if the court grants final approval and any appeals are finished, or the deadline to seek an appeal passes without one. The notice says it is uncertain whether appeals will be filed or how long they might take.
