Spencer v. CompuCom: Washington Job Posting Settlement Payments

The proposed $1,000,000 settlement covers people who applied for at least one job opening in Washington with CompuCom Systems between January 1, 2023 and the date of preliminary approval, where the posting did not disclose pay or benefits. Payments are automatic from the Defendant's records, and a class member who does nothing still receives one. Exclusions and objections are due November 13, 2026 and the final approval hearing is January 15, 2027; the court has not yet given final approval.

Questions & Answers

Do I need to file a claim or provide documents to get paid?

The notice describes payment as automatic for Settlement Class Members who stay in the settlement; it does not describe a claim form or supporting-document submission. To help make sure payment reaches you, confirm that the Settlement Administrator has your current mailing address. If you want digital payment instead of a mailed payment, make that selection by November 13, 2026.

The notice says payments depend on court approval and finality. Keeping your address current does not guarantee a payment if the settlement is not finally approved.

How much might my payment be?

Each Settlement Class Member who does not exclude themselves is eligible for an equal share of the Class Fund. The notice does not give a dollar amount for an individual payment; its estimated-payment line is blank.

The $1,000,000 Common Fund is also the source for requested attorneys’ fees, costs, expenses, and a service award to the named Plaintiff, if the Court approves them. Those amounts may affect what remains for class payments.

When would payments be sent, and how long would I have to use one?

The Court’s final approval hearing is scheduled for January 15, 2027, at 11:30 A.M. If the Court approves the settlement, payments are to be sent only after any appeals and other reviews are finished. The notice does not provide a specific payment date.

A payment expires 180 days after it is issued.

What happens if I do nothing?

If you do nothing and the settlement is approved, you remain in the Settlement Class, receive a mailed payment, and are bound by the settlement’s release. In practical terms, you give up the right to sue CompuCom and the other released parties over the claims covered by this settlement.

The release covers the claims asserted in this case during the period from January 1, 2023 through the preliminary-approval date. It does not waive claims outside that release.

How do I opt out, and what would that change?

To leave the settlement, mail an individual written exclusion request to the Settlement Administrator. It must be postmarked by November 13, 2026. You cannot opt out by phone or email, and group exclusion requests are not allowed.

The letter must give your full name and address, say that you want to be excluded from this settlement, and include your or your attorney’s signature and the date. If you opt out, you will not receive a settlement payment, but you will not release the claims covered by the settlement.

Can I object to the settlement instead of opting out?

You may object only if you remain in the Settlement Class. A written objection must be filed with King County Superior Court by November 13, 2026. You must also mail copies and any supporting documents to Class Counsel and CompuCom’s attorneys by that date.

The notice lists detailed information that an objection must include, including your contact information, your reasons for objecting, information about any attorney, whether you or the attorney plan to appear at the hearing, information about certain prior settlement objections, and a signature and date.

Do I have to attend the final approval hearing?

The hearing is scheduled for January 15, 2027, at 11:30 A.M. at the King County Courthouse in Seattle. The notice also provides a Zoom link for remote attendance.

You do not have to attend. If you submit a timely objection that meets the stated requirements, the Court will consider it even if you do not attend. The hearing date or time can change by court order.

How does the notice describe the payment for tax reporting?

The notice says settlement payments will be treated as non-wage damages and reported on a 1099.

Could my choice about this settlement affect my employment or application?

The notice says CompuCom will not retaliate against a class member for participating, not participating, or objecting. It also says those choices will not affect employment with CompuCom or treatment as an applicant, current employee, or former employee.
