Questions & Answers
How will my payment be calculated?
How much each person or entity receives is not a fixed refund amount. It depends on the CFFs they paid and on the remaining settlement fund.
- Your share starts with the total water and sewer Capital Facilities Fees (CFFs) you paid during the class period.
- The calculation adds 6% yearly interest from each payment date through September 16, 2024, then interest at the legal rate through August 1, 2026.
- Court-approved administration costs, service awards, and lawyers’ fees and expenses are paid from the fund before the remaining money is divided among class members.
- The notice estimates that awards could be about 105% of the principal CFFs paid, but this is only an estimate and depends on what the Court approves.
Do I need to file a claim or provide documents to receive a payment?
You do not need to opt in to receive the award described in this notice. But the notice puts the responsibility for contact-information updates on you.
- The notice says the Administrator will issue a check to a class member who does not timely and properly opt out.
- It does not describe a claim form or supporting-document requirement for receiving that check.
- Keep your contact information current. For a written update, include your unique Notice ID.
When will payments be sent?
The December 2026 hearing is not a payment date. The timing can be delayed by the approval process or appeals.
- Payments will be issued only after the Court enters a Final Order and Judgment.
- Any appeal must be resolved, or the time to appeal must expire, before awards are issued.
- The notice does not give a specific payment date.
What do I need to do if I want to opt out?
Opting out, also called excluding yourself, is different from objecting. It is the choice for someone who does not want to be part of this settlement.
- Send a written exclusion request to the Administrator, postmarked by November 23, 2026.
- Each person or entity seeking exclusion must individually sign the request.
- Include the class member’s name, address, and valid telephone number, and clearly state the intent to be excluded.
- Opting out means you will not receive a settlement award, but it preserves your ability to pursue your own case about the released claims.
How can I object, and can I speak at the hearing?
An objection asks the Court to consider concerns about the settlement, requested lawyers’ fees and expenses, or requested service awards. It does not remove you from the settlement.
- You may object only if you stay in the settlement; a person who opts out cannot object.
- A written objection must be postmarked no later than November 23, 2026, filed with the Court, and copies must be served on the Administrator, Class Counsel, and counsel for the City.
- The objection must include specific reasons, supporting legal or factual material, your name and address, your personal signature, and the other information listed in the notice.
- If you want to speak at the hearing, say so in your written objection. A separate statement of intent to appear has a November 30, 2026 deadline.
When and where is the Court hearing, and do I have to attend?
The hearing is where the Court will consider final approval of the settlement and related requests. Check the settlement updates for the exact schedule and format.
- The hearing is scheduled for the December 14, 2026 civil session of Wake County Superior Court at 316 Fayetteville St, Raleigh, North Carolina.
- The notice does not yet give the exact day, time, or final format for that week; it may be in person or by WebEx.
- You do not have to attend. A timely, complete written objection can still be considered without your attending.
What rights do I give up if I stay in the settlement?
Staying in the settlement provides the settlement payment but gives up the legal claims covered by the release. The notice directs readers to the Settlement Agreement for the full release terms.
- If you remain in the settlement and it becomes final, you release claims against the City and certain related people and entities arising from CFF payments during the class period.
- That includes claims that are known or unknown and claims for refunds, damages, interest, reimbursement, or other remedies related to those CFF payments.
- To keep the right to sue or continue another case over those released claims, you must opt out by the deadline.
