CBIZ Data Breach Settlement: Who Can Claim and What It Pays

Who Is Included

The settlement covers people CBIZ mailed a notice saying their Private Information may have been compromised in the 2024 Data Incident, subject to the listed exclusions.

  • Proof required: For documented-loss reimbursement, provide documentation reasonably supporting the loss and a brief description if the records do not show the nature of the loss. Self-prepared records alone are insufficient, and undocumented loss claims will be denied. The separate pro rata cash payment is available without out-of-pocket losses, but class membership is verified against the mailed-notice list and claims are subject to verification.

Questions & Answers

Can I request both the cash payment and reimbursement for losses?

You may seek both benefits in the same claim process: the separate pro rata cash payment and reimbursement for eligible out-of-pocket losses. You do not need to have an out-of-pocket loss to request the cash payment.

The reimbursement portion is limited to $5,000 per class member and requires documented losses or expenses connected to the incident.

What documentation do I need if I request reimbursement for losses?

Documents are required only if you seek reimbursement for out-of-pocket losses. The notice does not say that loss documents are needed for the separate pro rata cash payment.

  • Receipts or other records not prepared by you, such as bills or account records, may support a claim.
  • Include a short explanation of the loss if the documents do not make its nature clear.
  • A handwritten receipt or other self-prepared record alone is not enough. The notice says undocumented claims will be denied.

What kinds of out-of-pocket expenses may qualify for reimbursement?

The list is not exhaustive. The key conditions are that the expense must be documented and fairly traceable to the data incident.

  • Unreimbursed fraud or identity-theft losses.
  • Professional fees, including lawyer, accountant, or credit-repair fees.
  • Credit-freeze or unfreeze costs, qualifying credit-monitoring costs, and certain small expenses such as postage, mileage, copying, or phone charges.
  • Other mitigation costs fairly traceable to the incident, if incurred in or after 2024 and before you submit your claim.

Why might the payment amount be different from $100 or my claimed loss amount?

The roughly $100 figure is an estimate based on a 10% claim rate, not a promised amount. It can go up or down after attorneys’ fees and costs, administration costs, service awards, and valid loss-reimbursement claims are accounted for.

There is also a separate limit on loss reimbursements. If valid documented-loss claims total more than half of the Net Settlement Fund, each approved loss payment will be reduced proportionately.

What do I need to submit a claim?

A valid claim form must be submitted by December 24, 2026. If you do not know your Login ID, the notice directs you to contact the Settlement Administrator.

  • Use the Login ID printed on the front of your postcard notice to complete the claim form.
  • You can request a paper claim form by telephone, email, or mail if needed.
  • The Settlement Administrator will verify claims.

When and how would approved claims be paid?

Payments are not scheduled for a fixed date. They can be sent only if the Court approves the settlement and it becomes final, after any appeals or other reviews are finished.

Approved claimants will receive a check unless they choose electronic payment. A check expires 180 days after it is issued.

What must I do to exclude myself, and what changes if I do?

Leaving the settlement means you cannot receive settlement money, but you keep any right you may have to bring your own claim about the matters in this case. If you stay in the settlement, even without filing a claim, you are bound by the release if the settlement is approved.

  • Mail an exclusion request or exclusion form by November 24, 2026.
  • Include the case name and number, your full name and current address, your signature, and a clear statement that you want to opt out.
  • You cannot opt out by phone or email, and each person must make their own request.

How do I object to the settlement?

Objecting tells the Court why you believe it should not approve the settlement. It is different from opting out, which removes you from the settlement.

  • You must remain in the class; someone who opts out cannot object.
  • Mail a written objection to the Settlement Administrator by November 24, 2026, and also file it with the Court.
  • The objection must include your contact information, specific reasons, supporting documents if any, attorney information if applicable, whether you intend to appear at the hearing, information about certain prior class-settlement objections, and a signature.
