Brevard Skin & Cancer Center Data Breach: What You Can Claim

The settlement class includes living people in the United States who received a notice from BSCC saying their private information may have been affected by the September 2025 Data Incident.

It does not include BSCC directors, officers, or agents; government entities; the assigned judge, that judge’s immediate family, or court staff. People who timely leave the settlement are also excluded.

The monitoring benefit is offered alongside one of the two cash choices. You cannot receive both cash options. The $45 payment is instead of other payments, while the notice says all class members can claim monitoring and one cash option.

• One year of CyEx Medical Shield Complete medical data monitoring.
• One cash option: either reimbursement of documented losses, up to $2,500, or a $45 alternate cash payment.

For the documented-loss option, the loss must be an actual out-of-pocket loss caused by the Data Incident. It must have occurred from September 28, 2025 through November 16, 2026. Reimbursement is capped at $2,500.

• Losses from identity theft or fraud.
• Fees for credit reports, credit monitoring, or credit freezes and unfreezes.
• Costs to replace identification or postage used to contact banks by mail.

The $45 alternate cash option does not require proof or an explanation.

• Provide records such as bank statements or receipts showing what you lost or spent.
• The materials should show that the expense was caused by the Data Incident.
• Personal notes may help explain other proof, but notes alone do not support a valid claim.

Submit one signed cash-benefit claim per person. The official portal requires LoginID and PIN; the printable form asks for Login ID only if known. Request missing credentials from [email protected] with your name and mailing address.

• Online and emailed claims are due November 16, 2026. The portal and printable form permit emailing the completed form and supporting documents to [email protected].
• For postal claims, the notice and portal say postmarked by November 16, while the paper form says received by that date. Allow time for delivery or ask 1-833-360-6880 which rule applies; the sources do not resolve this difference.

The notice says enrollment codes were mailed by postcard. The paper cash-claim form has no monitoring-selection box. On September 9, 2026, the official site offered a separate LoginID/PIN form to request an email reminder with enrollment instructions once the settlement is final: https://www.brevardskindatasettlement.com/form/email-request/. A reminder request is not confirmation of active monitoring. Contact the administrator for a missing code or instructions; no enrollment deadline is stated in these sources.

• The service monitors healthcare insurance ID exposure, Medical Record Number exposure, and unauthorized Health Savings Account spending.
• It includes access to a fraud-resolution agent and $1 million of medical identity-theft insurance.

Leaving the settlement is called opting out. If you opt out, you will not receive settlement benefits, but you keep any rights you may have to bring your own case about the legal issues covered here. You may exclude only yourself, not another person.

• Send a written Request for Exclusion to the Settlement Administrator.
• Include the case name, your name, mailing address, telephone number, email address, personal signature, and a clear statement that you do not want to participate.
• Submit, postmark, or email it by November 2, 2026.

No. If you do nothing, you will not receive a benefit. Unless you opt out, you remain part of the settlement and give up the legal rights described in the settlement’s release section.

Not yet. The Court is scheduled to hold the final approval hearing on November 30, 2026 at 9:00 AM Eastern Time. Benefits can be distributed only if the Court grants final approval and any appeals have been resolved. The notice does not give a payment date.

The official homepage, https://www.brevardskindatasettlement.com/, listed the November 30 hearing as being held via Zoom when checked September 9, 2026. The notice also lists the courthouse and leaves the courtroom blank. Confirm attendance details with the administrator before making travel plans.

File with the Clerk of Court by November 2, 2026 and send copies to the administrator and both sides’ lawyers. Follow the complete checklist and addresses in notice question 16, pages 7–8. Besides your reasons and supporting material, it asks for prior objection history and orders, lawyer details, hearing plans and witnesses, whether artificial intelligence helped prepare the objection, and your own signature. An attorney signature alone is not sufficient. Objecting does not submit a cash claim or exclude you.
