Do I need to submit a claim now, and what will I need to provide?
The notice does not yet provide the steps for asking for payment. Those steps will be announced only after approval.
- You do not need to take action now merely to remain included. The notice says Class members are automatically included unless they opted out.
- If the Court approves the settlement, a later process will explain how to submit an individual claim for a share of the money. This notice does not give a claim form, claim deadline, submission method, document requirement, or payment date.
- The notice also does not say how the settlement will be divided among approved claimants. A distribution protocol, subject to Court approval, will determine compensation and a process will confirm whether each claimant qualifies as a Class member.
How much could I receive?
There is no stated individual payment amount in this notice.
- The defendant will pay $1,000,000 as the settlement amount if the settlement is approved.
- The notice does not promise a set payment to any person. Each claimant’s amount will depend on the yet-to-be-approved distribution protocol and the process that confirms Class membership.
- The Court will decide Class Counsel’s legal fees and disbursements. This notice does not state the amount of those fees or how the distribution protocol will allocate money among claimants.
What happens if I opt out?
Opting out means leaving the class action and settlement.
- To leave the settlement, you must complete and sign an opt-out form.
- Class Counsel must receive the form by mail, courier, or email no later than May 7, 2026, at 5:00 p.m. Pacific Standard Time.
- A person who opts out takes no further part in this case and cannot seek money through this class action. The notice says this choice is final.
Can I object to the settlement or the legal fees?
An objection is a way to tell the Court about a concern with the proposed settlement or the listed payments.
- Class members may object to approval of the settlement, Class Counsel’s fees, or an honorarium for the representative plaintiffs.
- To object, use the written objection form and email it to Class Counsel so it is received by May 7, 2026, at 5:00 p.m. Pacific Standard Time.
- Class members may also attend the settlement approval hearing.
When and where is the Court approval hearing?
The hearing is where the Court will be asked to approve the Settlement Agreement.
- The Court approval hearing is scheduled for June 12, 2026.
- It is to take place at 32375 Veteran’s Way, Abbotsford, BC, V2T 0B3, before Justice Caldwell or another justice appointed by the Court.
