Why is the individual payment only an estimate?
- The $644,105 fund is not divided only among claimants. It also pays settlement administration expenses, any court-approved attorneys’ fees and costs, and any court-approved service award for the class representative.
- After those amounts, each person with a timely valid claim receives an equal share of the remaining fund. The $950–$2,800 figure is only an estimate, not a guaranteed amount.
How will payment be sent?
- Payment will be sent using the payment method selected on the Claim Form if the settlement is approved and the claim is valid.
- The notice does not list the available payment-method choices.
What happens if I do nothing?
- Doing nothing means no payment.
- Unless a person formally excludes themself, they remain bound by the court’s orders and give up the covered claims, even if they never file a claim.
How do I exclude myself, and what does that change?
- To leave the settlement, mail a signed exclusion letter to the Settlement Administrator by the November 30, 2026 postmark deadline.
- The letter must include contact information, the case name and number, a statement that the person wants to be excluded, and a signature.
- A person who excludes themself cannot receive a settlement payment or object to the settlement, but does not release their claims against the Released Parties.
What is required to object to the settlement?
- An objection must be submitted in writing to the Cook County Circuit Court Clerk and copies must be sent to class counsel and defense counsel by November 30, 2026.
- It must provide the objector’s contact details, employment and timeclock-use dates, reasons and supporting material, information about certain prior class-action objections, and a signature.
- Someone who wants to speak at the hearing must say so in the written objection and identify planned witnesses and exhibits.
When should valid claimants expect payment?
- The court must give final approval before payments can be made.
- If approval becomes final, the notice expects payment within about 60 days after final approval. An appeal can delay payment.
- If the settlement is not finally approved or is overturned, there will be no payment from this fund at that time.
Do I need to attend the Final Approval Hearing?
- The Final Approval Hearing is scheduled for January 7, 2027, at 11:00 a.m. in Courtroom 2402 of the Circuit Court of Cook County in Chicago.
- Self-represented people may participate by Zoom using the meeting information in the notice. Attendance is not required.
