How is the payment amount determined?
The payment is not a guaranteed set amount. It depends on the number of valid claims and the final settlement funding amount.
- The notice says each timely, valid claimant receives an equal share of the Class Fund. It does not give a fixed payment amount in the notice itself; it says an estimated amount appears on the Claim Form sent to the recipient.
- The amount Defendants will pay is stated as a range from $269,513.00 to $395,000.00, depending on how many class members make claims. Court-approved fees and costs for Class Counsel are to come from the Settlement Fund.
What do I need to do to request a payment, and do I need supporting documents?
A Claim Form is required to seek a payment. Signing a form or using a notice ID is not described as documentary proof, and the notice does not specify any documents required from every claimant.
- Complete the Claim Form and submit it by the deadline. The notice permits submission by mail or email and says an online option is available, but its online instructions are inconsistent.
- Claims may be checked by the Settlement Administrator, which can ask for more information. The notice does not identify documents that every claimant must submit with the form.
- If your mailing address or phone number changes, contact the Settlement Administrator so payment can reach you.
What is the deadline to submit a claim?
The same date is also the deadline to ask to be excluded or to object, but those are different actions from submitting a claim.
- Your Claim Form must be submitted, or mailed with a postmark, no later than December 4, 2026.
- A late claim does not meet the stated requirement for payment.
When would payments be sent?
The notice does not provide a specific payment date. The February 5, 2027 hearing is scheduled to consider final approval, not a promised payment date.
- The Court must first give final approval.
- After approval, payments to people with timely, valid claims are to be sent by check once appeals and other reviews have finished, if any.
- A check becomes void 180 days after it is issued.
How does the notice describe the payment for tax reporting?
Consider seeking personal tax guidance if you need help understanding how a 1099 may affect you.
- The notice says settlement payments will be treated as non-wage damages and reported on a 1099.
- The notice does not provide individual tax advice or explain each person’s tax treatment.
What happens if I choose to exclude myself?
Each person must send their own request; group exclusion requests are not allowed.
- To leave the settlement, send a written exclusion request that is postmarked by December 4, 2026. You cannot exclude yourself by phone or email.
- The request must state your name and address, say that you want to be excluded, and include a signature and signing date.
- If you exclude yourself, you receive no settlement payment. In exchange, you are not bound by the settlement’s release of the covered claims.
Can I object to the settlement instead of leaving it?
An objection tells the Court what you disagree with. It does not remove you from the settlement.
- You may object only if you remain in the Settlement Class; you cannot both object and exclude yourself.
- File a written objection with King County Superior Court by December 4, 2026. The notice also requires copies and supporting documents to be mailed to Class Counsel and Defendants’ Counsel by that date.
- The notice lists required information, including your contact information, reasons for objecting, certain information about prior settlement objections, and a signature and date.
What happens if I do nothing?
In practical terms, doing nothing means no payment and no separate right to pursue the claims that this settlement resolves.
- If you do nothing, you will not receive a payment because a Claim Form is required.
- You remain in the Settlement Class unless you timely exclude yourself. If the settlement receives final approval, you will be bound by its release of the covered claims, even without filing a claim.
