ASP Aesthetics Text Message Settlement: Who Could Claim and Why

What does the Claim Form require?

• A payment is not automatic. Each person must submit their own Claim Form.
• Only one Claim Form is allowed for each Settlement Class Member.
• The form must be complete, accurate, timely, and valid. The notice also says it must be verified and include required affirmations and representations.
• The notice does not list the exact verification statements or say whether supporting documents are needed. Read the Claim Form carefully for those details.

How is the payment amount calculated?

• The payment is up to $55 for each text received after the person first asked ASP Aesthetics to stop texting.
• The notice limits payment to up to 10 texts, using the Settlement Class Data.
• That means the stated maximum is up to $550 for a person with 10 qualifying texts. It is not a promised payment amount.
• Payments come from the settlement fund after notice and administration costs, approved attorneys’ fees and expenses, and any service award are paid.

How do I leave the settlement instead of staying in it?

• Send a letter by mail to the Settlement Administrator at the address listed in the exclusion section of the notice.
• Personally sign the letter under penalty of perjury.
• State that you want to be excluded from the Settlement Class and that you otherwise are a member of the class.
• The request must be postmarked by May 1, 2026. You cannot opt out by phone, email, or the Settlement Website.
• You may opt out only for yourself. If you opt out, you cannot receive a settlement payment.

What is required if I want to object to the settlement?

• You may object only if you stay in the Settlement Class; a person who opts out cannot object.
• File the objection with the Court using its electronic filing system or another filing method the Court accepts.
• Mail the objection to the Clerk of the Court, Class Counsel, and Defendant’s Counsel. The notice lists all three addresses.
• The objection must be postmarked by May 1, 2026.
• It must include identifying information, a signed statement under penalty of perjury that you received a text and are a class member, your reasons for objecting, and information about whether you plan to attend the hearing. The notice lists additional requirements, particularly for an objection involving a lawyer.

What happens if I do nothing?

• If you do not submit a timely claim, you will not receive settlement benefits.
• Unless you opt out, you will still be bound by the Court’s judgment.
• Staying in the class also means giving up the right to sue ASP Aesthetics or the Released Parties over the issues resolved by this case, including through another lawsuit, arbitration, or proceeding.

When might approved claimants receive checks?

• Checks will be sent only if the Court grants final approval and any appeals are resolved.
• The notice says checks will be sent to the address provided on the Claim Form within 60 days after the Effective Date.
• The notice does not give a calendar payment date. Appeals or other approval steps can delay payment.
