Who is covered by the settlement?
- You may be in the Settlement Class if you were in the United States and, during the applicable class period, APN or someone acting for APN sent you more than one sales text or made more than one sales call within a 12-month period.
- Your residential phone number also must have been listed on the National Do Not Call Registry for at least 30 days before the contact. The notice excludes contacts made with express written consent or an established business relationship.
- The notice gives conflicting descriptions of the covered period and does not give the Preliminary Approval date. It describes the period on pages 1 and 3 as beginning May 9, 2021, while page 2 uses a different beginning point.
What payment can a claimant choose?
- If you make a valid, timely claim, you choose one benefit: a $100 voucher or a $20 cash payment.
- The voucher does not expire and may be redeemed for APN products or services. You receive one chosen payment per person, even if you received multiple qualifying texts or calls.
- The stated amounts can be reduced proportionally if the available fund cannot cover all valid claims. The fund is also used for approved attorneys’ fees, costs, administration costs, and any service award before claims are paid.
How do I submit a claim, and do I need documents?
- Submit a valid Claim Form by December 15, 2026. You can submit online through the settlement website, or request a paper form by calling the Settlement Administration and mail it postmarked by the deadline.
- The notice says to read the form’s instructions, complete it, and sign it. It does not say whether supporting documents must be sent with the form; that requirement is unspecified because the Claim Form is not included in this notice.
When would payments be sent?
- The Court must approve the settlement before payments can be made. Appeals may also occur, and the notice says no payments will be made until all appeals are final.
- The final approval hearing is scheduled for January 6, 2027, by video conference. The hearing date and time can change by court order.
How do I opt out, and what does that mean?
- To leave the settlement, mail a signed exclusion letter postmarked by December 15, 2026. Include your name, address, telephone number, and a statement that you want to be excluded from the Hazem Arman v. Al Piemonte Nissan settlement.
- You cannot opt out by phone, fax, or email. If you opt out, you will not receive a payment and cannot object, but you will not be bound by the settlement.
Can I object to the settlement?
- If you stay in the settlement, you can send a written objection by December 15, 2026. You must file it with the Court and send it to the Settlement Administrator.
- The objection must identify you, state your specific objections and their factual and legal basis, and provide the other information listed in the notice, including information about witnesses, any attorney, and prior class-action objections.
- You do not have to attend the hearing for the Court to consider a timely written objection that meets the requirements. If you want to speak at the hearing, say so in your objection.
What happens if I do nothing?
- If you do nothing, you will not receive money from this settlement.
- Unless you opt out, you will still be bound by the settlement if it becomes final. This means you cannot bring, continue, or join another lawsuit against APN over the released claims involving texts or calls during the Settlement Class Period.
