People affected by the FinWise Bank data incident have until October 29, 2026, to submit a settlement claim. The proposed $2.8 million settlement covers living U.S. residents whose private information was affected by the incident on or about May 31, 2024, including people who received a data-incident notice.

What the settlement offers

Eligible class members may choose between two cash options. They can request reimbursement of up to $5,000 for documented losses fairly traceable to the incident, or request a pro rata cash fund payment without proving a loss. California class members are eligible for a cash fund payment calculated at up to twice the amount paid to non-California class members.

Two years of three-bureau credit monitoring are also available in addition to either cash option. Claimants must select that service on the Claim Form if they want it. Actual cash fund payments will depend on the number of valid claims and the money remaining after approved settlement expenses.

Documents and deadlines

A Claim Form is required for every benefit. Anyone requesting documented-loss reimbursement should include reasonable records such as receipts or other non-self-prepared documentation showing the cost and its connection to the incident. The cash fund payment does not require loss documentation.

Claims may be submitted online through the official settlement website or mailed to the Settlement Administrator. Online claims must be submitted, and mailed claims postmarked, by October 29, 2026. The deadline to opt out or object is September 29, 2026.

What happens next

The U.S. District Court for the District of Utah has scheduled a final approval hearing for December 10, 2026, at 10:00 a.m. The hearing is not a payment date. Benefits will not be distributed unless the Court approves the settlement and any appeals are resolved.
