People who received repeated USA Clinics Group promotional texts after opting out, or while their number was on the National Do Not Call Registry, may qualify for money from a proposed $574,350 settlement. Valid claimants can receive up to $50 per qualifying message, with benefits capped at three messages and $150 per person.

The settlement resolves allegations under the Telephone Consumer Protection Act, or TCPA. USA Clinics Group denies wrongdoing, and the court has not decided which side is correct. Eligible recipients must submit a claim by October 5, 2026; doing nothing produces no payment.

Two kinds of text-message recipients may qualify

The class period runs from June 12, 2021, through June 16, 2026. The settlement covers people in the United States who were sent more than one USA Clinics Group text within a 12-month period concerning the company's goods or services and fit either of two circumstances.

The first group consists of people who continued receiving messages after telling USA Clinics Group to stop, including by replying with "stop" or a similar opt-out instruction. The second consists of people whose cellular number had been on the National Do Not Call Registry for at least 30 days and who had not given prior express invitation or permission to be contacted.

Receiving one message is not enough under the printed class definition. The notice also ties eligibility to USA Clinics Group messages and to the specific five-year class period.

The benefit is based on qualifying messages, up to three

An approved claimant may receive up to $50 for each qualifying text, but no more than three messages can be counted. That creates a maximum stated benefit of $150 per person, even if messages reached more than one of the person's phone numbers.

The $50 figure is not guaranteed. The same $574,350 fund must cover valid claims, notice and administration costs, court-approved legal fees and expenses, and any approved service award. If the fund cannot pay every approved message at $50, the per-message amount will be reduced uniformly on a proportional basis.

Money left after distribution will return to USA Clinics Group rather than being used for a second claimant distribution.

A notice LoginID is required to file

The claim form asks for the LoginID printed on the postcard notice. Someone who no longer has the notice can contact the settlement administrator for help obtaining the identifier.

Only one claim form should be submitted per person. That form covers qualifying messages sent to any of the claimant's phone numbers, subject to the three-message cap. No separate receipt or outside document is listed, but the form must be complete and signed, and the administrator will compare claims with USA Clinics Group's records.

The administrator may request more information. A claimant who does not respond in time can have the claim rejected, so filers should retain their confirmation and monitor the contact information they provide.

What the lawsuit alleged

The plaintiff alleged that USA Clinics Group sent repeated marketing texts after recipients opted out or to numbers on the National Do Not Call Registry without the required permission. The lawsuit says those messages violated the TCPA.

USA Clinics Group, a private health-care services company, denies the allegations, denies liability and disputes that the case should proceed as a class action outside the settlement. The proposed agreement is a compromise, not a court finding that the company broke the law.

Claimants who remain in the class will release covered telemarketing claims relating to USA Clinics Group texts during the class period. The settlement notice should be reviewed for the full release language.

How and when to submit a claim

Claims can be filed online through the official settlement website or mailed to the settlement administrator. Online claims are due by 11:59 p.m. Eastern on October 5, 2026; mailed forms must be postmarked by that date.

The final approval hearing is scheduled for September 18, 2026, at noon Eastern via Zoom in the Miami-Dade County Circuit Court. The hearing occurs before the claim deadline, but payments still must wait for final approval and the resolution of any appeals.

The notice's August 19 deadlines to object or opt out have already passed. Filing a claim remains the only route to a settlement payment for an eligible recipient.
