A proposed $5.3 million settlement could provide cash and identity-protection benefits to people who were sent notice of the November 2025 SitusAMC data incident. Eligible class members may seek up to $5,000 for documented losses and an estimated $75 flat payment, while qualifying California residents may request an additional $50 subject to possible reduction.

SitusAMC discovered the incident on or about November 12, 2025. The information involved varied by person and may have included names, dates of birth, Social Security or taxpayer identification numbers, driver's license or other government identifiers, financial account numbers, medical records, and health-insurance policy numbers. Plaintiffs allege that the company failed to take reasonable steps to protect personal information. SitusAMC denies the allegations, and the court has made no finding of wrongdoing.

Eligibility is tied to receiving an incident notice

The nationwide class consists of people identified on the class list who were sent notice of the incident. It is not defined simply by having done business with SitusAMC or one of its clients. People who did not receive notice should check with the settlement administrator before assuming they qualify.

The settlement also recognizes a California subclass for one benefit. To request the additional California payment, a class member must have resided in California between November 12 and November 22, 2025.

One monitoring benefit was offered automatically

Class members automatically received an enrollment code for one year of credit monitoring. The package includes real-time monitoring at a credit bureau, dark-web scanning, public-record monitoring, identity-restoration services, and $1 million in identity-theft insurance with no deductible.

An enrollment code is not the same as automatic activation. Recipients who want the service should follow the enrollment instructions and check any separate activation deadline. The monitoring package is a service benefit; the $1 million insurance figure is not a cash payment available to each class member.

The flat payment requires no proof, but still requires a claim

Class members may request a one-time flat cash payment without providing proof or an explanation. The notice estimates this payment at $75, but the amount may be higher or lower depending on valid claims and other settlement costs.

California subclass members can add a $50 statutory payment to the flat payment and documented-loss claim. That $50 benefit is also subject to downward pro-ration. None of these cash benefits is automatic: a valid and timely claim form is required.

Documented-loss claims have a stricter standard

The settlement offers reimbursement of up to $5,000 for actual, unreimbursed out-of-pocket losses caused by the incident. Examples include certain bank or credit-card charges, replacement costs for identification, credit reports, and qualifying monitoring or identity-protection purchases.

Third-party documentation such as receipts is required. Self-prepared documents may explain other records but are not sufficient on their own. For monitoring or identity-protection purchases made between November 12, 2025, and the claim deadline, the claimant must provide proof of purchase and a written statement that the service was bought primarily because of the incident.

The November deadline applies to every cash option

Claims must be submitted online by November 6, 2026, or mailed with a postmark no later than that date. The form requires the unique Class Member Login ID and PIN supplied with notice.

Claimants pursuing documented losses should allow time to gather records rather than waiting until the final day. A person seeking only the estimated flat payment does not need supporting proof, but must still complete the claim process.

Fund deductions and claim volume affect payments

The $5.3 million fund will first pay court-approved attorneys' fees and costs, service awards, and settlement administration expenses. Class counsel may seek up to one-third of the fund, and each class representative may request a $2,500 service award.

The remaining money funds class benefits, which is why the $75 and $50 amounts are estimates rather than guarantees. The court has scheduled a final approval hearing for November 11, 2026, at 10:00 a.m. Payments will follow only if approval becomes final and any appeals are resolved.
