The lawsuit alleges that American Well Corp., also known as Amwell, disclosed customers' medical information and confidential communications to third parties without permission. The claims invoke federal and California wiretap, medical-confidentiality, privacy and common-law protections. Amwell denies violating any law, the court has not decided which side is right, and the settlement is not an admission of wrongdoing.

Who is included in the LiveHealth Online settlement?

The settlement class covers people in the United States who used the appointment-booking tool on the LiveHealth Online website, iOS app or Android app between October 2024 and August 2025. The notice defines eligibility by use of that booking tool during the class period, not simply by having an account or using a different LiveHealth Online feature.

People who are uncertain whether their use qualifies can contact the settlement administrator or consult the official settlement site. The notice identifies Virginia Polk as the class representative and American Well Corp. as the defendant in Polk v. American Well Corp., Case No. 25CV026746.

Why the estimated payment is not guaranteed

Amwell has agreed to make up to $2,037,751.46 available. Valid claimants will receive equal pro-rata shares of the net settlement fund. The official notice estimates an individual payment of approximately $51.14 to $102.29, but it does not promise either figure or state a fixed maximum award.

The actual payment depends on how many class members submit valid claims and how much remains after court-approved deductions. The same fund will cover settlement administration and notice expenses, attorneys' fees and costs, and a service award for the class representative. Class counsel may seek no more than one-third of the fund in fees, although the court may award less.

A valid claim is required for payment

This is not an automatic-payment settlement. A class member who wants cash must complete and submit a Claim Form by October 30, 2026. Claims may be filed through the official settlement website or by printing and mailing the paper form available there.

The notice does not specify receipts or other supporting documents for the cash claim. It does require a valid Claim Form, and claims remain subject to review by the settlement administrator. Class members should follow the current instructions on the official site and avoid relying on the estimated payment as a guaranteed amount.

Approved payments will be issued by check unless a claimant elects PayPal or Venmo. Checks will expire 180 days after issuance. Distribution is scheduled for 45 days after the settlement becomes final and any appeals are complete, so payment will not immediately follow the claim deadline.

Doing nothing produces no payment but still releases claims

Class members who do nothing will not receive settlement money. Unless they exclude themselves, however, they will still release the claims covered by the settlement if it becomes final, regardless of whether they submitted a claim.

The deadline to request exclusion is October 30, 2026. Excluding yourself preserves the ability to pursue the released claims separately but gives up any payment from this settlement. The objection deadline is also October 30. Objecting keeps a person in the class and does not substitute for filing a Claim Form.

Court approval must come before distribution

The final approval hearing is scheduled for January 15, 2027, at 9:00 a.m. in Department 8A of the Sacramento Superior Court, 500 G Street, Sacramento, California.
