A proposed $3.75 million settlement could provide estimated $150 payments to people who completed certain HireVue video interviews while in Illinois and whose voice or facial information may have been collected.
The lawsuit alleges that HireVue used automated interview technology to collect voice and facial biometrics without first providing disclosures and obtaining written consent required by the Illinois Biometric Information Privacy Act. HireVue disputes the claims, denies collecting or possessing information covered by the law, and denies violating it. The settlement is not an admission of wrongdoing.
Who may qualify
The settlement class generally includes people who, while in Illinois, completed a HireVue interview involving the relevant technology between January 27, 2017 and June 25, 2026.
The class definition focuses on where the interview occurred and whether it involved the technology described in the notice. It is not a settlement for every person who used HireVue or completed a video interview elsewhere. People who received a settlement notice may have been identified as possible class members, but a valid and timely claim is still required for payment.
The case was brought under the Illinois Biometric Information Privacy Act, commonly called BIPA. The law regulates how private companies collect, store, transfer, and use biometric identifiers and information, including certain voice and facial scans. The plaintiffs allege that HireVue did not provide the required written disclosures or obtain written consent before collecting the information at issue.
Estimated payment from the settlement fund
HireVue agreed to create a $3.75 million settlement fund. After court-approved administration costs, attorneys' fees and expenses, and service awards are deducted, the remaining money would be divided equally among class members who submit valid claims.
The notice estimates a payment of approximately $150 per valid claimant. That figure could rise or fall depending primarily on the number of valid claims and the deductions approved by the court. Class counsel plans to request attorneys' fees of up to one-third of the gross fund, plus reasonable expenses. The three class representatives may each request a service award of up to $6,000.
Claimants would be able to choose a mailed check or electronic payment. Checks would expire 75 days after issuance, so recipients would need to deposit or cash them promptly.
Claims are due October 13, 2026
Anyone seeking payment must submit a Claim Form online or mail one postmarked by October 13, 2026. The notice says a valid, timely form is the only action required to receive a payment; it does not specify additional supporting documents.
People who do nothing will not receive money, but if the settlement becomes final they will generally remain bound by the release of covered claims. The deadline to request exclusion is September 28, 2026. A request may be sent by mail or email using the instructions in the official notice.
Class members may also object to the settlement. Objections must be received by the court no later than September 28, 2026 and must follow the notice's detailed filing and delivery requirements. Objecting is different from excluding yourself: an objector remains in the class if the settlement is approved.
Court approval is still required
The Circuit Court of Lake County, Illinois conditionally certified the class for settlement purposes and granted preliminary approval. A final approval hearing is scheduled for October 28, 2026 at 9 a.m. The notice does not state a timezone for that hearing.
At the hearing, the court will decide whether the settlement is fair and whether to approve requested fees, expenses, and service awards. If the settlement is approved and becomes effective, the administrator expects to issue payments after the required process is completed. Appeals or other proceedings could delay that timetable.
